§ 6:11 Justification—Discipline of minors
The defendant’s conduct, otherwise criminal, is justified when the defendant is the teacher, tutor, or parent of a minor and the conduct constitutes the reasonable discipline of the minor.
A minor is a person under the age of 18.
Thus, if you find:
(1) that the defendant was the [teacher, tutor, parent] of [victim]; and
(2) that [victim] was a minor; and
(3) that the defendant engaged in the conduct constituting the offense charged for the purpose of disciplining [victim]; and
(4) that the defendant’s conduct was a reasonable means of disciplining a minor; then you must find the defendant not guilty.
